To place an order, you must be of legal age or an emancipated minor, have sufficient legal capacity to act and possess a debit or credit card accepted by our payment system.
All orders shall be deemed to be offers to purchase subject to these Terms and Conditions. Time Road reserves the right to accept them if the requirements set out in these Terms and Conditions are not met.
Once an order has been placed, the system automatically generates a confirmation of receipt of the order. However, this confirmation does not imply automatic acceptance of the order, given that TIME ROAD reserves the right to request additional information related to identity and address to guarantee both the correct delivery of the order and to ensure that there is no fraud related to the transactions.
Orders can be placed 365 days a year at any time, except at times when the service is suspended for maintenance or other commercial circumstances and/or force majeure.
Any order is subject to product availability. In the event that it is not possible to deliver an order due to supply problems or insufficient stock, the user will have the option of waiting until the product is available or cancelling the order.
The photographs of the products are presented for descriptive and orientative purposes only and have no contractual value whatsoever. The specific characteristics of each product can be found in the corresponding descriptions on the website.
No valid order can be placed without expressly accepting, through the boxes provided for this purpose, these Terms and Conditions and TIME ROAD's Privacy Policy.
Delivery will be considered to have taken place at the moment in which the user or a third party indicated by the user acquires material possession of the products.
The delivery time for the order will vary according to the selected delivery method and will be indicated on the website once the order confirmation has been obtained, but in no case will it exceed 30 days from the date of the order confirmation. In the event that the delivery date cannot be met, we will inform the user of this circumstance and the user will be offered the option to go ahead with the purchase by setting a new delivery date or the possibility of cancelling the order and obtaining a full refund of the price paid.
If the recipient is absent at the time of delivery, a notice will be left so that he/she can pick up the shipment at the place and within the deadlines indicated. If the time limit expires without the shipment being picked up, it will be returned to TIME ROAD and the consumer will be responsible for contacting Customer Service for possible re-shipment at the purchaser's expense.
It is understood that the price of each product is the one that will appear on the website at the time of placing each order. The user must pay the marked price, including VAT, together with the shipping costs, which will be added to the final price to be paid. However, shipping costs may be included, depending on the shipping method chosen by the user
Prices may be modified by TIME ROAD at any time and without prior notice without affecting orders already confirmed. However, even when confirmed, TIME ROAD will not be obliged to honour orders when the price is incorrect, especially when the error is obvious and easily recognisable.
All products that TIME ROAD promotes at a special price will be displayed on the website with the following information:

Payments will be made using the accepted payment methods: Paypal and Visa or Mastercard credit or debit card and whose reference number is indicated in the purchase process, with the charge being made in real time, once the authenticity of the buyer's details has been checked, through the payment gateway of the corresponding financial institution.
TIME ROAD uses Redsys technology and secure payment systems. The data related to the payment is transmitted encrypted to the financial institutions issuing the cards and is subject to validation and verification by them.
TIME ROAD, S.L. will not make any shipment until the total amount of the order has been paid in full. If the card issuer refuses to grant authorisation for payment, the purchase will be automatically cancelled.
Royal Legislative Decree 1/2007, of 16 November, which approves the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws recognises the right of customers to withdraw from their purchase within 14 calendar days from the date of receipt of the product.

Exceptions to the right of withdrawal are those items that are not suitable for return for reasons of health protection or hygiene (earrings, piercings, etc.) provided that they have been removed from their original packaging.

In this case, it is essential that you print out and include the return label supplied with the order.
b) Stores with the TIME ROAD label in Spain, except for the Canary Islands, Ceuta and Melilla, and EL CORTE INGLES shops, as well as Festina Group Company Stores.
Previously, and through the website (My account > Return an order or an article), you will have to indicate in which Time Road shop the order is to be returned.
c) SEUR Pickup Points.
In this case, following SEUR's instructions after initiating the return via My Account > Return an order or an article, the corresponding return label must be printed and the product must be delivered to the chosen SEUR Pickup point.
Delivery conditions:
The returned product(s) must be in perfect condition and with the accessories, documentation and original packaging.
Consequences of withdrawal:
In the event of withdrawal, TIME ROAD will refund all payments received, including delivery costs (with the exception of additional costs resulting from the customer's choice of a delivery method other than the least expensive ordinary delivery method offered) without undue delay and, in any case, no later than 14 calendar days from the date on which you are informed of your decision to withdraw from this contract. The reimbursement will be made using the same means of payment used by the customer for the initial transaction, unless expressly provided otherwise; in any case, no costs will be incurred as a result of the reimbursement.
Notwithstanding the foregoing, TIME ROAD may withhold the refund until it has received the goods or until the customer has provided proof of the return of the goods, whichever condition is met first.
The user will bear the shipping costs of the return, according to the delivery method chosen:
a) TIME ROAD Logistics Centre: The return costs to be borne by the user will depend on the transport company chosen by the user (Time Road recommends the use of a certified means of shipment that requires the signature of the recipient).
b) Time Road Stores. No return costs.
C) SEUR Pickup Points. Return costs: 4,95€.
The products offered through the TIME ROAD website enjoy the legal guarantee of TWO (2) years established by the Royal Legislative Decree 1/2007, of 16 November, which approves the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws to cover the lack of conformity of the products.In the case of Spain, it will be THREE (3) years from the date of purchase of the product, provided that it has been acquired as of January 1, 2022.
In any case, any damage caused by ordinary wear and tear or by improper use of the products will be understood to be excluded from the legal guarantee.
Without prejudice to the rights recognised to consumers in the current legislation for defective products (RDL 1/2007 and other applicable regulations), the manufacturers of the products marketed by TIME ROAD can offer a voluntary and additional Commercial guarantee on their products.
The conditions for exercising this Commercial Guarantee are explicitly formalised in the International Guarantee Certificates that, where applicable, are supplied with each item purchased.
Once the first 14 days have elapsed from receipt of the order by the customer and without prejudice to the right of withdrawal referred to in the previous section, the invocation of any aspect of the legal or commercial guarantee (repair/replacement/reduction of the price/cancellation of the contract, etc.) with respect to TIME ROAD as seller may be made at any point of sale with a TIME ROAD label in Spain, except for the Canary Islands, Ceuta and Melilla, or at EL CORTE INGLES establishments.
In order to invoke the legal guarantee, it will be essential to present a receipt or invoice for any claim or request for exchange and/or return.
To invoke the Commercial Guarantee with the manufacturer, it will also be necessary to provide the international Guarantee Certificate stamped by the establishment.
For any repair service , the customer will be provided with an estimate drawn up, where applicable, by the official Technical Service (TAS) of each brand, indicating the amount. Any variation in the estimate will be previously communicated for confirmation.
The deposit receipts will always be nominative. If repairs are collected by a person other than the holder, the authorisation that appears on the receipt must be completed. In any case, the identity of the holder of the receipt must be accredited by means of a DNI, NIE, or passport.
Without prejudice to the right of withdrawal and the right to replacement of products as a result of the exercise of the legal or commercial guarantee provided for in Royal Legislative Decree 1/2007, the user may choose, at any point of sale with a TIME ROAD label within 14 days of delivery of the goods, to exchange the products purchased for others of the same or greater value (except for El Corte Inglés corners and Festina Group Company Stores).
It is essential that the exchange is for a product or products of equal or greater value than that previously purchased.
To make the exchange, the user must go to any of our Time Road shops indicated with the delivery note received together with the order and the item/s to be exchanged.
TIME ROAD, S.L. owns all intellectual and industrial property rights to the website, and all of its contents, such as text, graphics, photographs, logos, icons, images, graphic design, source code, applications, video, audio, etc., are subject to intellectual and industrial property rights recognized by national and international legislation in force, except for those that belong to third parties unrelated to TIME ROAD.
Any use of the website or its contents must be exclusively private.
Any use involving the copying, reproduction, distribution, transformation, public communication or any other similar action of all or part of the contents of the website, as well as of the website itself, is reserved exclusively to TIME ROAD, S.L., and therefore no user may carry out these actions without the prior written authorisation of TIME ROAD, S.L.
The user must not make any improper use of the web page by intentionally introducing viruses or any other material that may be harmful or damaging. TIME ROAD reserves the right to transfer, assign, encumber, subcontract or otherwise transfer a contract or any of the rights or obligations arising from it, at any time during its term.
TIME ROAD is responsible for the fulfillment of its own legal and contractual obligations, consequent to the execution of these Terms and Conditions. In return, the user is responsible for the fulfilment of his or her own obligations under the same terms.
To the extent that TIME ROAD suffers any damage as a result of the actions and/or omissions of third parties related to these Terms and Conditions, TIME ROAD reserves the right to take appropriate action against them.
TIME ROAD is not responsible for any failure or delay in the performance of any of the obligations assumed when such failures are due to events beyond the reasonable control of the company.
Events beyond TIME ROAD's reasonable control include (the following list is not exhaustive):
- Strikes, lockouts or other industrial action.
- Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared) or threat or preparation for war.
- Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic, or any other natural disaster.
- Inability to use trains, ships, aircraft, motor transport or other means of transport, public or private.
- Impossibility of using public or private telecommunications systems.
- Acts, decrees, legislation, regulations or restrictions of any government or public authority.

No waiver or limitation of TIME ROAD's rights and remedies shall be deemed a waiver if TIME ROAD is not required in writing to comply with the obligations assumed by the user by virtue of a contract or these Terms and Conditions. At the same time, it shall not exempt the user from complying with such obligations. Likewise, any waiver by this party of a specific right or action shall not waive any other rights or actions arising from a contract or these Conditions, unless such waiver is formalised unequivocally and in writing through the means set out in the section on Communications to the user.
Connection to the website is at the user's own risk. TIME ROAD disclaims all responsibility for the connection to the Internet and the telecommunications network in general. The user is solely responsible for the protection of his or her computer and the applications and data installed or stored on it, and must take the necessary measures to protect it.
TIME ROAD's computer systems will store the computer records of orders, electronic communications inherent to them and invoicing, constituting proof of their reality and content, in accordance with the provisions of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce, and other applicable regulations.
In the event that any of these terms and conditions are declared null and void or declared invalid by a competent authority, the remaining terms and conditions will remain in force.
The Conditions set forth herein, as well as the documents referred to herein, constitute the Terms and Conditions between the user and TIME ROAD and supersede any particular agreement, tacit or express, verbal or written.
These General Terms and Conditions shall be interpreted and applied in accordance with current Spanish legislation, without prejudice to other mandatory rules that may be of preferential application.
In the event of conflict, the Courts and Tribunals that the Spanish legal system provides for at any given time shall have jurisdiction, where applicable, objectively, functionally and territorially.

Disputes arising from the use of the website or the interpretation, application and execution of contracts will be subject to the jurisdiction of the Courts and Tribunals determined by current Spanish legislation.
